Listing Terms and Conditions

These Listing Terms and Conditions ("Listing Terms") govern the relationship between Migration Registry (ABN 41 914 562 602), trading as MIGI ("MIGI", "we", "us", "our"), and any migration agent or migration business ("you", "your") that claims or manages a profile on migi.com.au (the "Site").

By claiming a profile, you agree to be bound by these Listing Terms, our Terms of Use, and our Privacy Policy.

1. The Directory Service

MIGI is an online directory that lists registered migration agents and migration businesses in Australia. We source initial listing data from the publicly available MARA Register maintained by the Office of the Migration Agents Registration Authority (OMARA).

2. Business Listing

By claiming your profile, you may manage and enhance your listing, including editing profile content and receiving enquiries through the Site. Available features may change from time to time.

Some features are paid. Fees, billing cadence, and cancellation terms are set out at the point of purchase via Stripe Checkout.

3. Your Obligations

By claiming a profile, you represent and warrant that:

  • You are a registered migration agent with a current MARN, or an authorised representative of a registered migration business
  • All information you provide for your listing is accurate, current, and not misleading
  • You will promptly update your listing information if it changes
  • You will notify us immediately if your MARA registration is cancelled, suspended, or subject to conditions
  • You have the right to use any logos, images, or content you upload to your listing
  • You will comply with all applicable laws, including the Migration Act 1958 (Cth), the Migration Agents Code of Conduct, and the Australian Consumer Law

You are solely responsible for the accuracy of the information displayed on your listing. We do not verify the accuracy of agent-submitted content beyond confirming MARA registration status.

4. Our Rights

We reserve the right to:

  • Remove or suspend any listing at our sole discretion, including where:
    • Your MARA registration is cancelled, suspended, or expired
    • Your listing contains inaccurate, misleading, or inappropriate content
    • We receive a complaint about your listing or services
    • You breach these Listing Terms
  • Modify listing features with reasonable notice
  • Update your listing with current information from the MARA Register, which may override agent-submitted information where there is a conflict (e.g., registration status)

5. No Endorsement

A listing on MIGI does not constitute an endorsement, recommendation, or guarantee by MIGI of your services, qualifications, or competence.

We do not assess or guarantee the quality of services provided by any listed agent or business.

6. Content Licence

By uploading content to your listing (including business descriptions, biographies, logos, and images), you grant MIGI a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content for the purpose of operating and promoting the directory.

This licence continues for as long as the content is displayed on the Site. Upon removal of content (by you or by us), the licence terminates, except that cached or archived copies may persist for a reasonable period.

You retain ownership of all content you upload. You warrant that you own or have the right to licence all content you upload and that it does not infringe any third party's intellectual property rights.

7. Liability

Your liability to us

You agree to indemnify and hold harmless MIGI, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Listing Terms
  • Any content you upload to your listing
  • Your provision of migration services to clients who found you through the Site
  • Any claim that your listing content infringes a third party's intellectual property rights

Our liability to you

To the maximum extent permitted by law, MIGI will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your listing, including loss of revenue, clients, or business opportunities.

Nothing in these Listing Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

8. Complaints and Disputes

If you have a complaint about your listing, contact us at admin@migi.com.au.

If your complaint relates to the conduct of another migration agent listed on the Site, we recommend contacting OMARA directly:

9. Term and Termination

These Listing Terms commence when you claim a profile and continue until:

  • We terminate your listing in accordance with Section 4
  • You request removal of your claimed profile

Sections that by their nature should survive termination will survive, including Sections 5 (No Endorsement), 6 (Content Licence — for the wind-down period), 7 (Liability), and this Section 9.

10. Changes to These Terms

We may update these Listing Terms from time to time. Changes will be posted on this page with an updated "Last updated" date.

11. Governing Law

These Listing Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

12. Severability

If any provision of these Listing Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
